On April 4, 2022, at around 2:11 a.m., a Missoula Police Department Officer was dispatched to a report of suspicious activity on Central Avenue. Dispatch advised that there was a report of a female, Jane Doe, holding a small child who was dragged into a residence by a taller white male. However, the 911 caller refused to provide a name.

The officer contacted Jane Doe after knocking on the door of the residence multiple times. Jane Doe answered and the officer observed that Jane Doe’s appearance looked as if she just woke up. The officer inquired why someone would call regarding her safety and Jane Doe stated the person who called to make the report was a “psycho.” She provided the name Derrick Irvine as the caller.

Jane Doe reported that Irvine is “obsessed with me”. Jane Doe provided Irvine’s phone number. A short time later, the officer confirmed the number that called 911 matched Irvine’s number.

Court documents indicate Jane Doe had known Irvine for a year, but they were just friends. Irvine wanted to be more than friends and the relationship became problematic to the point where Jane Doe decided to block Irvine’s number.

On March 30, 2022, Irvine came into Jane Doe’s residence uninvited and unannounced. She was sleeping and her young child let Irvine enter the residence. She woke up and saw Irvine in the hallway. This “freaked her out” and she told Irvine to leave, which he did.

On April 6, 2022, law enforcement was dispatched to South Russell Street regarding multiple reports of shots fired. Around the time the reports came in, Jane Doe contacted law enforcement reporting that her fiancée’s vehicle had “ten bullet” holes in it.

Officers contacted the fiancée, John Doe. John Doe reported that he noticed Irvine in a vehicle near his residence. John Doe was aware that Irvine had been watching his fiancée and wanted to investigate further. Irvine fled in his vehicle and John Doe followed him in his own vehicle.

After driving around south Missoula, Irvine stopped and exited his vehicle in the area of Russell Street and 34th Street. Irvine raised a firearm and began firing rounds at John Doe’s vehicle. Several rounds struck John Doe’s vehicle. John Doe placed his vehicle in reverse, later pulling a U-turn, in an attempt to flee. Irvine continued firing at John Doe’s vehicle while John Doe fled.

Law enforcement went to Irvine’s residence. Irvine came out and was arrested without incident.

An officer observed John Doe’s vehicle and saw a bullet hole in the front bumper on the driver side, a bullet hole in the grill of the driver’s side, two bullet holes on the driver side above the headlight on the fender, a bullet hole in the bottom corner of the windshield on the driver side, the driver side visor was torn in a way that appeared to be from a bullet, the back window was shattered, both front tires were flat, and the rear passenger tire was flat.

Law enforcement secured the scene and located a total of 11 shell casings. Officers also located a bullet hole in a nearby residence. Officers contacted the homeowner who advised nobody in the residence was injured.

On Thursday afternoon, Irvine made his initial appearance in Missoula Justice Court. Deputy County Attorney Marthe Van Sinkle provided the following statement.

“Your honor, the state will be asking for a $250,000 bond, minimum, in this case,” said Van Sickle. “The defendant has one prior felony for a robbery conviction back in 2009. There are safety concerns here as well. There was a shooting in this case. Bullets went into the cab of the truck. One bullet also went into a home nearby. That is a significant safety concern.”

Irvine’s bail was set at $200,000. He is currently being charged with felony attempted deliberate homicide, felony criminal endangerment, stalking, and false reports to law enforcement.
